Terms of Service

Parkoza ("we", "us", "our", or "the Platform") is a technology intermediary that operates an online marketplace connecting individuals who wish to list their private parking spaces ("Owners") with individuals who wish to book those spaces ("Renters"). Together, Owners and Renters are referred to as "Users."

Parkoza is strictly a platform service provider. We do not own, manage, control, operate, or inspect any parking space listed on this Platform. We do not employ Owners, act as their agents, or assume any responsibility for the condition, legality, safety, or availability of listed spaces.

The contract for the use of a parking space is formed solely and directly between the Owner and the Renter. Parkoza is not a party to that contract and has no obligation or liability arising from it.

By accessing or using the Parkoza website, mobile application, or any related services (collectively, the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in full, you must immediately cease using the Services. Your continued use of the Services constitutes your ongoing acceptance of these Terms and any future amendments.

These Terms constitute a legally binding agreement between you and Parkoza. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 18 years of age and legally capable of entering into binding contracts under applicable Indian law to use this Platform.

By creating an account, you represent and warrant that all information you provide is accurate, current, and complete, and that you will maintain and update such information as necessary.

Parkoza reserves the right to refuse registration, suspend, or terminate any account at its sole discretion without prior notice or liability.

Owners are solely responsible for ensuring that they have full legal right, authority, and permission to list their parking space on the Platform. This includes obtaining any necessary consent from landlords, housing societies, municipal authorities, or any other relevant parties.

Owners must ensure that their listed space complies with all applicable laws, regulations, bye-laws, and municipal rules. Parkoza makes no representation regarding the legality of any listing.

Owners are solely responsible for the physical condition, safety, access, and maintenance of their parking space. Any accidents, injuries, theft, vandalism, or property damage occurring on or around the listed space are the sole responsibility of the Owner.

Owners must ensure that all listing information — including photographs, dimensions, access hours, vehicle type compatibility, and pricing — is accurate and not misleading.

Owners acknowledge that income earned from renting their parking space may be subject to income tax and other applicable taxes under Indian law, and are solely responsible for meeting their tax obligations. Parkoza does not provide tax advice.

Renters are solely responsible for ensuring that their vehicle is lawfully registered, insured, and roadworthy in accordance with applicable law.

Renters must use the booked parking space only for the vehicle type and duration specified in their booking, and must comply with any access instructions or conditions set by the Owner.

Renters must not cause any damage to the parking space, surrounding property, or any third-party property. Renters are solely and fully liable for any damage, loss, or injury they cause to the Owner's space or any other property.

Renters must not use the parking space for any unlawful purpose, including but not limited to storing stolen vehicles, contraband, or hazardous materials.

Renters acknowledge that Parkoza does not guarantee the availability, condition, or safety of any parking space, and that they use any space entirely at their own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARKOZA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

(a) Loss of, theft of, or damage to any vehicle parked using the Platform;

(b) Bodily injury, death, or property damage arising from or related to the use of any listed parking space;

(c) Disputes between Owners and Renters regarding bookings, payments, access, or condition of the space;

(d) Unauthorised access to or use of a parking space;

(e) Failure of an Owner to provide access to a booked space;

(f) Any act or omission of any User, whether negligent, fraudulent, or otherwise;

(g) Any loss of income, revenue, profits, or data arising from use of or inability to use the Services;

(h) Any third-party claims, actions, or demands brought against any User.

Parkoza's total aggregate liability to any User for any and all claims arising under or in connection with these Terms shall not exceed the platform fee actually paid by such User to Parkoza in respect of the specific booking giving rise to the claim, in the three (3) months preceding the date the claim arose.

You agree to fully indemnify, defend, and hold harmless Parkoza and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

(a) Your use of the Services or any parking space booked or listed through the Platform;

(b) Your violation of these Terms or any applicable law or regulation;

(c) Your violation of any rights of any third party, including other Users;

(d) Any dispute between you and another User, or between you and any third party;

(e) Any misrepresentation made by you on the Platform.

Parkoza reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate fully with Parkoza in asserting any available defences.

Parkoza is not obligated to intervene in or resolve any dispute between an Owner and a Renter. Any disputes regarding the condition of a parking space, access, damage, refunds, or any other matter are to be resolved directly between the parties.

Where Parkoza chooses, at its sole discretion, to assist with a dispute, such assistance does not create any obligation or liability on the part of Parkoza, nor does it imply that Parkoza endorses the position of either party.

Users agree to attempt in good faith to resolve disputes amicably before pursuing any legal action.

All payments on the Platform are processed by third-party payment service providers (including Razorpay). Parkoza does not store or process card or banking details and is not responsible for any payment failures, errors, or fraudulent transactions caused by the payment gateway or third parties.

Parkoza charges a platform service fee on each booking, which is deducted from the total amount before the Owner's payout. This fee is non-refundable except as expressly stated in our Refund Policy.

All listed prices are in Indian Rupees (INR). Renters are responsible for paying the full amount shown at the time of booking, including any applicable service fees and taxes.

You agree not to use the Platform to:

(a) Post false, misleading, or fraudulent listings or information;

(b) Circumvent the Platform's payment system or arrange off-platform transactions with other Users you met through the Platform;

(c) Harass, threaten, or intimidate other Users;

(d) Use the Platform for any unlawful purpose or in violation of any applicable law;

(e) Scrape, copy, or extract data from the Platform without our written consent;

(f) Attempt to gain unauthorised access to our systems or any User's account.

Violation of this section may result in immediate termination of your account and may be reported to law enforcement authorities.

All content on the Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of Parkoza or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose. You may not reproduce, distribute, modify, or create derivative works of any content without our express written consent.

By submitting content to the Platform (including listing descriptions and photographs), you grant Parkoza a royalty-free, worldwide, perpetual licence to use, display, and reproduce such content in connection with the Services.

Parkoza may suspend or permanently terminate your access to the Platform at any time, with or without cause, and with or without notice, without liability to you.

Upon termination, your right to use the Services immediately ceases. Provisions of these Terms that by their nature should survive termination shall do so, including but not limited to Sections 6 (Limitation of Liability), 7 (Indemnification), and 14 (Governing Law).

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Parkoza does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Services entirely at your own risk.

Parkoza does not verify the identity, credentials, or intentions of Users, and makes no guarantee regarding the accuracy of any listing, the conduct of any User, or the safety of any parking space.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

Before initiating legal proceedings, parties agree to attempt resolution through binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad.

Parkoza reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. For material changes, we may provide additional notice via email or in-app notification.
